What is a legal separation?

A legal separation, according to the law in the state of Georgia, means that you and your spouse are no longer living as husband and wife, in other words, not having sex. While the courts in Georgia don’t grant a legal separation, but you and your spouse must swear to the court that you are residing in a state of separation.

What is separate maintenance?

Instead of filing for divorce you and your spouse can file a separate maintenance lawsuit. All the same issues would have to be resolved, such as child support, custody, spousal support, and asset division.  Many couples file for separate maintenance due to their religious beliefs or, in some cases, legal issues such as medical insurance. A separate maintenance lawsuit does not mean you are divorced and neither of you are allowed to remarry unless you get a divorce. You can file a separate maintenance lawsuit and then get divorced at a later date if your situation changes.
